NOTICE TO ALL RENTERS AND ADVERTISERS

 1.     Investigation – Users of this site are urged to thoroughly investigate all claims make by Renters, Property Owners, Advertisers or Agent/Managers.  Gay-VacationRentals.com assumes no responsibility for the accuracy of any information.  Information contained herein is for info purposes only and does not constitute a recommendation by Gay-VacationRentals.com.  It is recommended that renters request additional photos, obtain references from past renters, inquire where else the property is advertised, request the street address and look said address up on sites such as maps.google.com.  Always speak to the owner via phone before sending money and try to avoid using wire transfers.  For additional protection, check the property with the local Better Business Bureau and/or purchase travel insurance, such as insuremytrip.com

 2.     Policies – Gay-VacationRentals.com advises users to request a copy of all of advertisers’ policies and insist on a written property lease/rental agreement.

 3.     Refunds/Cancellations – It is recommended that renters receive a written notice of the Advertisers Refund/Cancellation policy.  These policies are set by the owners and may vary from property to property.  Gay-VacationRentals.com is not responsible for refunds under any circumstances.  Travel insurance is suggested.

 4.     Disclaimer of Warranty – Gay-VacationRentals.com, its advertisers and principals disclaim all express and implied warranties with regard to the information, services and materials contained on this site, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  All such information, services, and materials are provided “as is” and “as available” without warranty of any kind.  Gay-VacationRentals.com is not a licensed real estate broker in any location.  The sole objective of our site is to provide a service to unite property owners/service providers and prospective renters of vacation property.  Gay-VacationRentals.com is not responsible for renting your property.

 5.     Limitation of Liability – In no event shall Gay-VacationRentals.com or its advertisers and principals be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business, data or profits, litigation, whether based on breach of contract, tort (including negligence), product liability or otherwise.  In the event the operators of Gay-VacationRentals.com are unable to provide the promised level of service for any reason, including, but not limited to service outages, war, acts of God, or negligence, neither Gay-VacationRentals.com or it owners can be held liable for any costs beyond the prorated fees paid by the client but were not provided.  Gay-VacationRentals.com does not guarantee that the website will be available 100% of the time.  This agreement shall be construed in accordance with the laws of Orange County, Florida and any and all disputes shall be submitted to the jurisdiction of Orange County, Florida.

 6.     Indemnification – Users agree to indemnify, defend and hold harmless Gay-VacationRentals.com, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys reasonable fees), related to (i) your violation of this agreement, and (ii) your posting of material to this site.

 7.     Proprietary Rights – All materials on this site, including property information,  photos, and layout and organization of the site are owned and copyrighted by Gay-VacationRentals.com or its suppliers and may be accessed, downloaded or printed for your personal non-commercial use only.  You may not copy, distribute or transfer any material on this site, except for property information and photos, for use in whole or in part, without the written permission of Gay-VacationRentals.com.

 8.     Modifications to Site or Agreement – Gay-VacationRentals.com may make improvements or changes in the information, services, products, or materials on this site, or terminate this site at any time without notice.  Gay-VacationRentals.com may modify this agreement at any time and such modifications shall be effective immediately upon posting of the modified agreement.  Accordingly, users agree to review the agreement periodically, and your continued use or access of this site shall be deemed your acceptance of the modified agreement.

 9.     Membership Cancellation – Gay-VacationRentals.com listings run on an annual basis.  Due to the fact that the vast majority of the work involved in promoting vacation rental properties on the Internet occurs in the first few weeks of creating the ad, adding photos, etc, and due to the fact that Gay-VacationRentals.com is lower priced than most competing websites, there will be no refunds after the listing is online.

 10.   Property off the Market – If you remove your property from the market, we can temporarily inactivate the listing and reactivate it at a future date.  Your listing will stay in force through the original term and the renewal date does not change.

 11.   Property Sold – If you sell your property, you can transfer your listing to the new owner for a one time transfer fee of $15 (normally paid by the new owner).  Note that no refund will be given for the listing fee.

 12.   Spamming Policy – Gay-VacationRentals.com does not participate nor tolerate the sending of unsolicited commercial email.  We reserve the right to cancel the membership (without refund) of any member that mentions Gay-VacationRentals.com or any of its associated websites, URLs, or any associated Gay-VacationRentals.com email address in any SPAM email message or Usenet posting. 

 13.   Rental Inquiries – Property inquiries are delivered via Internet email which is known to be not 100% reliable.  Gay-VacationRentals.com cannot be held responsible for undelivered inquires or lost income due to undelivered inquiries.  We recommend that you be sure to add Gay-VacationRentals.com to your “white list” of approved email addresses so that inquiries are not sent to SPAM by your filters. 

 14.   Privacy Policy – Gay-VacationRentals.com will NEVER sell or distribute its mailing lists.  The security of our members information is very important to us.  The personal information of all of members or visitors are not posted anywhere on the website.  Potential renters must fill out an online form to contact our members, which in turn will be emailed to you.  A user will never know the email address of our members until you the member emails back to the renter.  All personal information between Gay-VacationRentals.com and our registered users is exchanged over SSL secure pages.

 15.   Miscellaneous Membership Policies -- Gay-VacationRentals.com reserves the right to edit or reject and ad submitted at our sole discretion.  We desire to protect our integrity as well as that of our users by providing a clean website, therefore any content considered by Gay-VacationRentals.com to be offensive will either be edited or removed, or the entire listing removed.  Note that any listing that is removed for inappropriate content will not be refunded.  Property owners are responsible for complying with all local regulations including but not limited to occupancy/sales taxes, licenses/permits and safety issues.

16. Gay-vacations.com is not a licensed real estate broker in any state and is not acting as the property management agent for any property owner
